我国土壤污染防治法律体系研究

摘要针对国内土壤污染防治立法体系现状，分析土壤污染防治法律体系的不足，包括缺乏专门立法、体系不完善、责任主体不明确、操作性不强和滞后性等问题。通过对国外土壤污染防治法律体系的研究，结合我国实际情况，提出完善我国土壤污染防治法律体系的建议。

Abstract Aiming at the status of soil pollution prevention and control legal system in China， the shortcomings were analyzed， including lack of special legislation， system is not perfect， the main responsibility is not clear， the operation is not strong and lagging. Based on the research of the foreign legal system of the prevention and control for soil pollution， combined with China's national conditions， suggestions for perfecting China's soil pollution prevention and control legal system were put forward.

改革开放后，历经三十年飞速发展，我国成为超越日本仅次于美国的世界第二大经济体。随着经济社会的发展，我国土壤环境问题愈演愈烈，土壤环境质量的好坏直接关系着生态环境质量的好坏，直接关系着人类生存环境的质量以及生态文明的构建。

2013年1月23日国务院发布了《国务院办公厅关于印发近期土壤环境保护和綜合治理工作安排的通知》（国办发〈2013〉7号），通知中明确强调“将研究起草土壤环境保护专门法规”等相关内容。那么进一步深入开展我国土壤污染防治立法的研究工作是十分迫切和必要的。

1国内外土壤污染防治立法现状

1.1国内土壤污染防治立法现状在我国，没有像欧美其他国家一样针对土壤污染防治而专门立法。我国现行法律中有关土壤污染防治的法律规范详见表1。

1.2国外土壤保护立法现状

国外土壤污染历史比我国长久，所以很多国家在上个世纪70年代就开始了土壤污染防治立法工作，上个世纪末基本形成比较完善的土壤保护立法体系。详见表2。……
