大学图书馆管理法制思维的基本要求

摘 要 法治思维是图书馆管理，特别是图书馆制度创新的保证。结合大学图书馆实践，文章从规则思维、权利保障思维、权力制约思维、责任思维、程序思维5个方面解读了大学图书馆管理法制思维的基本要求，剖析了法治思维在大学图书馆改革创新中的运用。

Abstract The rule of law thinking is the guarantee of the library management， especially the innovation of the library system. 党的十八大报告“法治思维”的提出，具有划时代的意义。将法治的思维方式应用到图书馆管理中，图书馆各级领导干部和广大基层馆员就要时刻牢记用法律标尺来衡量自己的行为，在切实维护自身、读者、信息产品提供方等各方利益的前提下，推动图书馆的变革与可持续发展。

1 大学图书馆管理法制思维

大学图书馆管理法制思维是基于法治的本质属性和对法治的科学信念，认识并解决大学图书馆管理中内外部的各类矛盾的思维方式。它受法律规范和程序约束、指引的思维方式。大学图书馆管理法制思维的核心在于约束、限制利益各方任意行使權力，维护社会公平正义。

2 大学图书馆管理法治思维的基本要求

2.1 规则思维

在大学图书馆管理中提倡规则思维，就要尊重并遵守各职能部门制定的大学图书馆管理规则，依据规则具体分析对所遇到的问题，从而推动问题的理性解决。

法律规范之间如有层级冲突，应当坚持上位阶的法律规范优于下位阶的法律规范的适用规则。为此，高校领导与大学图书馆馆员应认真学习并自觉遵守教育部教高〔2015〕14号印发的具备法律效力的《普通高等学校图书馆规程》，并在此基础上制订出符合自身发展实际的图书馆管理规范。……
