依法治体中的司法问题
——基于我国法院裁判文书的考察

摘要司法是依法治体的重要环节。对我国法院裁判文书的考察表明,我国法官一直基于广义理解并适用体育法。除援引作为基本法的《体育法》外,我国法院还惯常引用《奥林匹克标志保护条例》《全民健身条例》等体育行政法规、规章,《奥林匹克宪章》《中国足球协会章程》等境内外体育组织章程乃至体育技术规则作为体育纠纷案件的裁判依据。现实生活中客观存在的体育纠纷解决需求使得体育法的司法适用逐年递增,而法官对《体育法》的深入理解、裁判文书对体育特殊性的考量、独立体育仲裁机构的设置和现行《体育法》立法缺失的补正，都能成为完善依法治体中司法问题的路径。

Justice in the Sport Governance by Law: Based on the Observation of Adjudicative Documents from Chinese Law Courts∥ZHAO Yi

AbstractJustice plays an important part in the sport governance by law.The study on the observation of adjudicative documents from Chinese law courts shows that judges interpret and apply sports law in a broad sense.BesidesSportsLawofPeople’sRepublicofChina,administrative regulations likeRegulationforProtectingOlympicSymbol,RegulationsonNationalFitness,and charters of sports organizations likeOlympicCharter,CharterofCFAas well as sports technical rules are often cited by courts.The growing demand of solving sports dispute causes the increasing judicial need for sports cases.Therefore,the better understanding ofSportsLawfrom judges,the consideration of the specialty of sports from adjudicative documents,the establishment of an independent arbitration organization and the modification of legislative sports law can effectively better justice in the sport governance by law.

1问题与方法

1.1研究缘起司法是法治的重要环节之一,党的十八届四中全会通过的《中共中央关于全面推进依法治国若干重大问题的决定》指出:“实现科学立法、严格执法、公正司法、全民守法,促进国家治理体系和治理能力现代化。”由此可见,依法治体也应至少包括4个维度:体育立法的科学性和优良性、体育行政主管机关依法行政、司法机关公正处理体育纠纷和大众树立体育法治意识。在现代国家的3种基本权力划分中,司法权是和立法权、行政权并列的重要权力,是解决社会纠纷的最终力量。……
