一起伪劣农药“吡效隆”造成西瓜损失的司法鉴定案例分析

摘 要：该文分析了一起因生产销售伪劣农药“吡效隆”导致农户种植西瓜产生损失的案件。嫌疑人凌某将“吡效隆”通过代理商销售给瓜农，瓜农使用该农药导致西瓜坐果率降低，产量损失严重。通过书证审查和田间试验调查等方法，认定农民的经济损失与使用“吡效隆”农药有因果关系，并用科学的方法估算出农民的经济损失。鉴定意见质证后被法院采信。

A Case Study on the Agricultural Judicial Identification of the Losses of Watermelon Caused by One Kind of Fake and Inferior Pesticides Named Forchlorfenuron

Abstract：A case was analyzed on the yield loss of watermelon caused by one kind of fake and inferior pesticides named forchlorfenuron， which was sold to growers by a suspect that's family named Ling. After using the pesticide， result the decrease of watermelon fruit setting rate， which could cause serious yield lost. Through the written evidence review，on-site inspection and laboratory determination methods，it was found that the economic loss of watermelon was caused by using forchlorfenuron. Meanwhile， the farmers' economic losses were estimated by using scientific methods. And the expert opinion was accepted after cross-examination by the court.

1 案情简介

2013年12月凌某伙同他人以3.5元/盒的价格卖给林某1 600盒标称为宁夏某公司生产的“吡效隆”农药，林某将购回的“吡效隆”以5元/盒的价格批发给周某与王某，后三人分别以7.0～7.5元/盒的价格进行零售，至案发前，已全部销售出去。2014年3月下旬，江苏省D市90余户瓜农使用该“吡效隆”农药授粉后无效，西瓜无法坐果，造成了严重的经济损失，遂向当地农委、公安局报案。D市农委将抽样封存的涉案标称生产日期20140328、标注有效成分0.1%氯吡脲的“吡效隆”农药送国家农药质量监督检验中心（北京）和江苏省农产品检验测试中心检验，结果均为未检出；送检的标称生产日期为20140102的“吡效隆”农药样品经江苏省农产品检验测试中心检验，内含有效成分氯吡脲为0.03%，远低于农药标签上标注的0.1%氯吡脲的含量。经D市农业委员会、公证处、公安局现场实地考察，使用该种“吡效隆”农药的瓜农92户，总种植面积147.86hm2，用药面积107.60hm2，折实用药面积60.03hm2，因用假药多用人工3 964.75个。……
