浅谈施工索赔管理的现状及对策分析

【摘要】本文主要探讨在建筑施工造价管理中，一项复杂的经营管理工作——施工索赔管理。笔者从不同角度对工程施工索赔的原因进行了全面分析，并在索赔管理的合理、合法基础上，提出了加强建筑工程施工索赔管理的对策，并重点剖析建筑工程施工索赔的技巧，对如何加强建筑工程施工索赔管理进行深入的探讨与分析。

【Abstract】This paper mainly discusses the complex management and management work in the construction cost management - construction claim management. 施工索赔管理是建筑工程项目合同管理的重要内容，在项目实施中，建筑施工企业对于工程索赔的理解、认识与实践较国际惯例相比仍存在明显的差距。首先是健全的招投标机制使绝大多数建筑工程项目低价中标。其次是不健全的工程索赔机制使建筑施工企业经济投入和损失得不到应有的补偿，更有甚者将面临企业亏损。因此，索赔逐渐成为施工企业必不可少的管理行为，施工索赔管理是维护承包商合法利益的一项根本性管理措施。承包商在施工过程中必须加强施工索赔管理，按照工程合同条款的规定，对合同价格进行适当调整，以弥补承包商不应承担的损失，尽可能使工程合同的风险分担合理。本文笔者结合自身工作经验，对如何加强建筑工程施工索赔管理进行对策探讨与分析。
