新《档案法》实施背景下我国档案法规体系建设要求

摘要：2021年1月1日，新修订的《中华人民共和国档案法》正式实施，为我国档案法规体系建设带来新契机的同时也提出了新要求：以“三个走向”为遵循，明确方向指引；以“姓党听党”为基调，把握基本属性；以人民利益为中心，彰显价值追求；以新法内容为依据，关注重要变化；以现实问题为导向，化解实践难题。

Abstract：On January 1， 2021， the newly re？ vised“Archives Law”was officially implemented， which brings new opportunities for the construc？ tion of archival laws and regulations system in Chi？ na. At the same time， it also puts forward new re？ quirements： to follow the "three trends" and make clear the direction； to grasp the basic attribute with the keynote of "following the party"； to highlight the value pursuit with the peoples interests as the cen？ ter； to focus on important changes with the content of the new law as the gist； to take problems as the guidance and solve practical problems.

2021年1月1日，新修订的《中华人民共和国档案法》（以下简称《档案法》）正式实施。这为我国档案法规体系建设带来了新契机，也提出了新要求。笔者在中国知网CNKI检索发现，当前关于“档案法规体系建设”的研究主要集中在档案法规体系结构框架[1-2]、档案法规体系发展历程及建设现状[3]、行业档案法规体系建设[4]、档案法规体系完善对策[5-6]等方面，尚未就新《档案法》对我国档案法规体系建设提出的新要求做系统论述。新《档案法》出台后，中央档案馆馆长、国家档案局局长陆国强指出：“要构建起系统完备、科学规范、可操作性强的档案法规体系。”[7]这就要求首先明确作为我国档案法治事业核心遵从的新《档案法》对我国档案法规体系建设提出了哪些新要求，只有这样，我国档案法规体系建设才能在正确的航道上不断前行。本文即围绕此展开分析，以期为我国档案法规体系建设提供一些参考与借鉴。
