基于新修订《档案法》的档案利用权与公布权权责问题研究

摘要：2020年6月20日，新修订的《中华人民共和国档案法》颁布，对档案利用与档案公布条款进行了修正。文章基于新修订《档案法》涉及的档案利用与档案公布条款，回顾了我国档案利用权与公布权讨论热点，分析了现存法规在公布与利用的权责、公布审核程序以及国外立法趋势中存在的问题，最后提出要转变档案开放思想，完善开放鉴定程序，取消公布权的审核，以及进一步完善档案法与相关法律法规的关系的建议。

Research on the Rights and Responsibilities of Archival Access and Publication Rights based on the Newly Revised Archives Law

Abstract：Based on the provisions of the newly revised Archives Law on the use and publication of archives， this paper reviews the brief history and discussion hot spots of the development of the right to use and publish archives in China， analyzes the existing laws and regulations in the right and responsibility of publication and utilization， the procedures for publication and audit， and the trend of foreign legislation， and finally puts forward some suggestions to change the open mind of archives， improve the open identification procedure， cancel the audit of the right to publish， and further improve the relationship between the archives law and relevant laws and regulations.

2020年6月20日，新修订的《中华人民共和国档案法》（以下简称“新修订《档案法》”）由第十三届全国人民代表大会常务委员会第十九次会议通过并以第47号主席令公布，这标志着我国依法治档进入了新的历史阶段。新修订《档案法》相较于2016年修订的《档案法》，在档案的开放利用方面，缩短了其封闭期，设立了档案用户的救济权，调节了《档案法》与《政府信息公开条例》等法规之间的关系，体现了习近平总书记“依法治国、依法执政、依法行政”的治国思想，更加符合现代档案工作的发展需要。其中，对档案开放利用与档案公布等条款的修订也引起学者们的广泛关注，其内容关系到档案开放利用工作能否良好开展，档案的作用能否有效发挥。“小智治事，大智治制”。本文基于新修订《档案法》涉及的档案利用与档案公布条款，对档案公布权权责问题展开研究。
