食品投诉举报制度对农产品质量安全投诉举报制度构建的启示

摘  要： 農产品质量安全投诉举报制度拓展了公众参与农产品质量安全治理的渠道，有助于构建社会共治的农产品质量安全监管工作格局.该文在梳理国内食品投诉举报制度发展现状的基础上，总结了国内目前食品投诉举报制度遇到的现实困境和主要问题，可对构建农产品质量安全投诉举报制度起到借鉴和启示作用，并最终形成5点建议.

Suggestions of food complaint reporting system on construction of agricultural product quality and safety complaint reporting system

Abstract： The construction of agricultural product quality and safety complaint reporting system could expand channels for the public to participate in the management of the quality and safety of agricultural products and contribute to the construction of social co-governance patterns of agricultural products.Based on the analysis of current status of food complaint reporting system in China，this study summarized the realistic dilemmas and major problems of domestic food complaint reporting system and proposed five suggestions which could be used for reference and enlightening to construct the complaint reporting system of agricultural product.

0  引 言

农产品质量安全投诉举报制度不仅能够有效保护公众的公共利益和合法权益，而且拓展了公众参与农产品质量安全治理的渠道，为农产品质量安全监管部门发现和打击与农产品质量安全有关的违法犯罪行为提供帮助，有效改善监管力量不足的问题，有助于构建社会共治的农产品质量安全监管工作格局.农产品质量安全投诉举报制度应尽早纳入保障我国农产品质量安全的基本制度性框架之下.

《中华人民共和国农产品质量安全法》（2006版）第38条已初步具备农产品质量安全投诉举报制度的雏形：“国家鼓励单位和个人对农产品质量安全进行社会监督.任何单位和个人都有权对违反本法的行为进行检举、揭发和控告.有关部门收到相关的检举、揭发和控告后，应当及时处理”.然而，第38条并没有对农产品质量安全投诉举报制度具体的途径渠道、各部门职责，以及制度实施……
