数据开放共享与个人隐私保护对策研究

摘 要：[目的/意義]大数据时代，数据价值的进一步挖掘与利用对数据共享开放的深度和广度提出了新要求。数据加速共享开放使得数据应用与服务进入到崭新的阶段，在发挥更大数据价值的同时，也暴露出新形势下个人隐私数据的泄露现象。因此，如何保持数据开放共享与个人隐私保护的平衡成为大数据价值发挥必须解决的难题。[方法/过程]本文采用文献研究法总结近年来国内外学者在数据开放共享与隐私保护领域的相关研究、主要问题与发展趋势，创新性地从不同主体与不同数据形态的隐私泄露进行归纳，提出更具操作性的对策建议。[结果/结论]针对数据共享开放、数据应用与服务过程中数据的不同形态，从技术实践、管理制度层面提出基于“层次数据”与“算法问责”相结合的应对策略，为探索兼顾数据共享开放与个人隐私保护提供新路径。

Abstract：[Purpose/Significance]In the era of big data，data value mining and utilization put forward new requirements for the depth and breadth of data sharing and opening.The acceleration of data sharing and opening makes it enter a new stage of data application and service which leads to a new form of personal privacy data leakage.The balance between data open sharing and personal privacy protection has become a problem that must be solved to play the value of big data.[Method/Process]This paper summarized the research status，main problems and development trend of domestic and foreign scholars in the field of data open sharing and privacy protection in recent years by using the literature research method and innovatively summarized the privacy leakage from different subjects and different data forms and then put forward more operable protection countermeasures.[Result/Conclusion]According to the different forms of data in the process of data sharing，opening，application and service，this paper put forward a strategy based on the combination of“hierarchical data”and“algorithm accountability”from the aspects of technical practice and management mechanism.It provided a new path to balance the open data sharing and privacy protection.

近年来，数据共享开放的重要性及数据应用与服务高阶应用的潜在价值日趋显现。大数据时代，社会生活中的产品和服务逐渐转变为数据形态，数据资源的应用与服务正在逐步渗透到国民经济的各个行业和领域。国家在战略层面也对数据共享开放作出了明确部署：2017年，国家出台《政务信息系统整合共享实施方案》《政务信息资源目录编制指南（试行）》等多项政策文件，持续推进政府数据汇聚、共享、开放等，取得了实质性进展。……
