?论公共图书馆服务的软法治理

摘 要 在治理现代化加速转型的背景下，软法已成为公共图书馆服务治理的重要途径。我国公共图书馆服务领域存在着“软硬兼施”的混合法结构。相对于“硬法”“软法”以其自身有别于“硬法”之特点在公共图书馆服务治理方面发挥着重要作用。针对当前软法治理中民主参与不足、责任缺失、效力疲软等方面的困境，未来应当协调公共图书馆服务软硬法关系，优化公共图书馆服务软法创制与实施机制，合理配置软法实施的引导性资源，切实提高公共图书馆服务治理的软法实效。

Abstract Under the background of accelerating the transformation of governance modernization， soft law has become an important way of public library service governance. There is a mixed law structure of “both hard and soft” in the field of public library service in China. Compared with “hard law”， “soft law” plays an important role in public library service governance because of its own characteristics different from “hard law”. In the face of the difficulties of insufficient democratic participation， lack of responsibility and weak effectiveness in the soft law governance， we should coordinate the relationship between the soft law and the hard law in the public library service， optimize the creation and implementation mechanism of the soft law in the public library service， reasonably allocate the guiding resources for the implementation of the soft law， and effectively improve the effectiveness of the soft law in the public library service governance.

在中国特色社会主义文化建设和国家治理现代化的双重背景下，公共图书馆服务领域的治理愈加呈现为“软硬兼备”的法律结构。借助软法的理论工具，有助于我们分析当下公共图书馆服务领域制度运行中的一些规律性事实。从治理的立场来看，作为调整公共图书馆服务的软法规范，它们既存在于正式制度与规则里面，又存在于非正式的制度安排之中。文章从各图书馆网站、协会网站、北大法宝与北大法意数据库中随机筛选了100份规范性文件作为样本进行讨论，这100份文件中既有中央层面的规范性文件，也有地方层面的规范性文件，分别占比为27%与73%。文章以开放的法律规范角度就公共图书馆服务软法治理展开分析，探讨公共图书馆服务软法的类型功能和治理模式等问题，以期实现公共图书馆服务领域的善治愿景。……
