平遥古城现状及立法保护研究

摘要：平遥古城具有多种多样的历史建筑类型，而且文化遗存非常丰富，具有非常浓厚的文化积淀，保存历史风貌方面也非常完整。然而受到一定的政策法规的制约，古城在管理和立法保护方面具有较大的压力，一定要集中职能进行进一步的规划和整合，并且将古城保护体制进一步的完善起来，发挥相关的作用，进行多元化投入机制的管理，通过立法等方式对责任进行明确，加强监督管理体制。

Abstract： Famous for its rich cultural relics， diverse historic architectures，and profound cultural deposits，the historic features of Pingyao ancient city are well preserved， and its management system is improving as well.However，owing to backward rules and regulations，its legislative protection and management tasks are becoming more and more cumbersome.In this condition，we need to make integral planning and centralize functions so as to form a scientific and comprehensive protective system and developing method for ancient cities.And we need to develop a diversified investment mechanism in all dimensions，strengthen responsibilities by legislation，and improve enforcement and oversight mechanism.

1 平遥古城保护与管理现状

1.1 历史风貌完整，文物丰富

古城主要由民居、寺庙、店铺、街道等共同组成，是一个非常庞大的古建筑群，而且平遥古城的整体城池特点鲜明，布局规范，在平遥古城的周围出现了我国历朝历代的各种珍贵文物，平遥古城墙是当前在我国当中非常完整的古城墙，在古城当中具有非常多的文物，而且这些文物的分布非常密集，在我国一些县、市当中是十分罕见的。

1.2 理体制逐步完善

平遥县自从上世纪90年代就进行了文物局的设置，对文物进行综合保护，另外先后还成立了古城消防站、园林绿化局、城市规划部门等与平遥古城保护相协调的职能部门，对古城的管理和保护更为明确，加强科学化的管理，尤其是在进行城市管理行政执法局的建立之后，进一步的集中改革了县城当中的城市管理行政处罚权，并且对平遥县治安管理……
