法治视域下高校学籍档案开发利用规范化研究

摘 要

以高等学校学籍档案开发利用为中心，从档案法治视角出发，探讨开发利用过程中的法律风险及防范对策。通过明晰学籍档案与学生个人档案、人事档案学历部分之间的关系，规范开发利用的前置程序，规范开发利用的形制等措施，可在现有法律框架下实现高校学籍档案开发利用的规范化操作，优化档案服务水平，提高档案利用效率。

Abstract Focusing on the development and utilization of college studentsstatus archives， the paper explores the legal risks and prevention measures in the process of development and utilization from the perspective of the rule of law in archives. Measures such as clarifying the relationship between the studentsstatus archives and studentspersonal archives and education part of personnel archives， standardizing the pre-program of development and utilization and standardizing forms and regulations of development and utilization can realize the standardized operation of the development and utilization of college studentsstatus archives under the existing legal framework， optimize the level of archives service and improve the efficiency of archives utilization.

近年来，随着全社会践行社会主义法治理念以及诚信观念和档案意识的不断增强，在诸如考试、就业、出国、户口迁移等领域，有关部门进行许可审核时，普遍要求申请人提供其学历信息的佐证材料，由此，使得高校学籍档案的查阅利用率达到近年来的高峰[1]27。与此同时，一些新的问题应运而生，如学籍档案界定问题、有关证明文件效力问题、个人信息保护问题等。高校档案馆（室）在学籍档案提供利用过程中，如何能在法治理念指导下，更加规范地履行职能，成为摆在我们面前亟待解决的问题。

一、当前高校学籍类档案开发利用的现状

1.开发利用的领域。随着我国市场经济发展日趋成熟，依法治国理念在社会各领域的深入贯彻以及诚信观念之深入人心，档案的凭证作用日趋加强。高校档案馆（室）在提供利用学籍类档案时，也面向不同领域行使职能，具体表现如下：（1）人事档案领域的利用。一是干部人事档案“三龄二历一身份”的审定认定工作中，针对学历信息不清、不全的情况，需要由相关学籍档案进行佐证和补充。……
