信用承诺制建设存在的问题与对策建议

摘要：在我国积极探索推进信用监管体系构建，强化事中事后监管的过程中，信用承诺作为一种重要手段被引入和提出。从信用承诺制度建设的背景、发展现状等四个方面分析了存在的主要问题，并给出对策建议，以期信用承诺制度能够充分发挥正面作用，助推我国信用监管体系构建，社会治理体系和治理能力现代化。

On the problems and Countermeasures in the construction of credit commitment system of the construction of the government's credit supervision system

Abstract： In the process of actively exploring and promoting the construction of credit supervision system and strengthening the supervision in process and afterwards， credit commitment is introduced and proposed as an important means.This paper introduces the background and development status of the construction of credit commitment system， analyzes the main problems from four aspects， and gives countermeasures and suggestions， in order to give full play to the positive role of credit commitment system， promote the construction of credit supervision system in China， and modernize the social governance system and governance capacity.

一、信用承诺制建设背景

自国家推进“放管服”改革以来，2013-2017年期间，先后取消和下放国务院部门行政审批事项的比例达44%，清理规范国务院行政审批中介服务事项达74%，工商登记前置审批事项压减87%。在“放”和“服”上，取得了巨大进展。但是，“放”并不等于放任自由，还要有相应的“管”。目前，国家正在探索推进“双随机、一公开”和信用监管两种监管方式。

在构建信用监管体系时，信用承诺制度被提了出來。2014年6月，国务院印发的《社会信用体系建设规划纲要（2014-2020年）》提出“逐步建立行政许可申请人信用承诺制度，并开展申请人信用审查”。2019年7月，《国务院办公厅关于加快推进社会信用体系建设构建以信用为基础的新型监管机制的指导意见》提出，建立健全信用承诺制度。在办理适用信用承诺制的行政许可事项时，申请人承诺符合审批条件并提交有关材料的，应予即时办理，信用状况较好的，加快办理进度。书面承诺履约情况记入信用记录，作为事中、事后监管的重要依据。……
