非营利性民办高校民主参与治理的法治衡量指标体系研究

摘  要：本课题旨在实证研究的基础上，通过对非营利性民办高校的具体法律制度和相关政策研究，对民主参与治理尝试形成一定的法治衡量指标，确立以民主指标为基、公益指标为旨、制度指标为形、内涵指标为本、经济指标为源、信息指标为体、文明指标为综的法治衡量指标，使教职工依法参与治理的工作具有直观性和可测度;建构可持续的操作规范、提供可复制的法治素材;通过民主法治的路径滋养孕育高校法治文化的生成和生长;推动高校治理体系与治理能力现代化进程。

Abstract： The study of the subject is to the discussion and preparation of construction plan for applying for non-profit private demonstration university， in the discussing and preparing process， professional and concentrated consideration are carried out by using legal knowledge. Based on the specific institutional analysis， empirical research are carried out， the study tries to form a certain comprehensive measurement indicator of monocracy， a democracy indicator as the basis， the public interest indicator as the purpose， the institution indicator as the shape， the connotation indicator as the key， the economy indicator as the source， information indicator as the body， the civilization indicator as the comprehensive measurement indicator.The study hopes to make the governance work which non-profit private university faculty staff participate in are intuitive and measurable. By constructing such sustainable， feasible and long-term operational norms， some law materials are providedwhich can copied， learned and promoted， and so the modernization of governance system and governance capacity in non-profit private universities can be realized， and thus enhance the modern internal governance capacityand the implementation of the rule of law in vocational institutions.

依法治校是高校管理与服务的基本方式，而民主参与治理是依法治校的底色，是加強高校顶层设计的底气，是高校法治文化滋润、生成和生长的主要营养元素。如何衡量一所高校是否依法治理，民主参与治理的成分或量化指标是不可或缺的。

一、民主参与治理的法治支撑

党的十八届四中全会关于全面依法治国的决定，党的十九大报告中提出加强社会主义法治文化建设的规定，还有中共中央关于加强民办高校党的建设的规定等，从政治组织的顶层设计可以看出，在非营利性民办高校依法治理、民主参与过程中，必须加强党组织的政治核心和监督保障，充分发挥党的政治文化的引领作用;新修订的民办教育促进法第十九条规定举办者在经营方式上可以自主选择，第二十一条理事会成员中应该有教职工，以及二十七条对教职工民主参与治理的形式和权利做出明确规定;中长期教育发展规划纲要、尤其是教育部依法治校纲要等。……
