农业领域国家地理标志产品保护现状

摘 要：《乡村振兴促进法（草案）》提出加强对新品种、新产品的研发，加强农业知识产权保护。增强农业知识产权保护，不仅有利于农民增加额外收入，而且能更好地促进农业实现现代化。本文以国家地理标志产品鄢陵蜡梅为例，探讨农业领域国家地理标志产品保护，分析了鄢陵蜡梅保护现状及其保护过程中存在的问题，并提出了相应的建议。

Products in the Field of Agriculture

—Taking Yanling Chimonanthus as an Example

Abstract： Put forward to strengthen the new varieties， new product development， strengthen intellectual property protection in agriculture. Strengthening the protection of agricultural intellectual property rights is not only conducive to increasing farmers' additional income， but also better promote the realization of agricultural modernization. Taking the national geographical indication product Yanling Chimonanthus praecox as an example， this paper discussed the protection of national geographical indication products in the field of agriculture， analyzed the current situation and problems in the protection process of Yanling Chimonanthus praecox， and put forward corresponding suggestions.

地理標志是知识产权客体中的一种。当某一产品被批准地理标志保护以后，说明该产品不仅特色鲜明，而且品质优于其他产地，这凸显了此种农产品的独特优势。地理标志产品保护有利于提高市场竞争力，增强农产品的知名度。但目前，我国对地理标志的保护起步晚，地理标志保护的规定分布较零散，政策法规形式类条文居多，未形成完整的保护体系，导致我国农产品地理标志产品保护流于形式。中国作为一个农业大国，要想在激烈的竞争中占据一席之地，必须完善地理标志产品保护制度，提高地理标志产品质量。

1 地理标志保护产品概述

地理标志保护产品是指在特定地区生产，其质量、声誉或其他特征取决于该产地的自然和人文环境，经国务院主管部门批准以地理名称加产品名称命名的产品。在《中华人民共和国民法典》中，地理标志被视为与作品、专利、商标和商业秘密平行的知识产权客体。……
