【摘 要】随着石油化工装置、煤制油、煤化工装置的逐步建设和运行,生产装置为解决产品升级、扩能、环保和节能等技术问题,势必会进行一系列技术改造,技术改造所选的承包方式既要达到改造的效果,又要满足合规合法的需求。技术改造工程的承包方式,是业主和承包商共同面临的问题。论文通过对不同承包方式的分析,对技术改造中各类承包方式的选择展开研究,从而提高业主投资的有效性,兼顾承包商的合理利益。
【Abstract】With the gradual construction and operation of petrochemical equipment, coal-to-oil and coal-chemical equipment, production equipment is bound to carry out a series of technical transformation to solve technical problems such as product upgrading, capacity expansion, environmental protection and energy conservation. The contracting method selected for technical transformation should not only meet the effect of transformation, but also meet the requirements of compliance and legality. The contracting method of technical transformation project is a common problem faced by both the owner and the contractor. Through the analysis of different contracting methods, this paper studies the selection of various contracting methods in the technical transformation, so as to improve the effectiveness of the owner's investment and take into account the reasonable interests of the contractor.

1 引言
技术改造工程不同于基建工程,一般是在已经建成的装置区域内进行局部新建、扩建部分功能设施,实现产品升级增效、环保和节能。常规承包方式基本存在以下几种:EPC(设计、采购、施工)总承包工程,俗称“交钥匙”工程,业主将涉及工程的设计、采购和施工全部委托一家承包商(含联合体)执行。E+PC(采购、施工)施工总承包工程,业主委托一家承包商进行设计,委托另外一家承包商进行采购和施工,共同完成工程建设任务。E+P+C工程,业主将工程的设计、施工分别委托有资质的单位进行,采购一般情况由业主自己完成。其中施工承包的类别不同,业主还有框架单位进行实施,方式较为多样化。
2 各类承包方式的优缺点
2.1 EPC总承包工程
总承包工程对于业主来讲,不受规模的限制,无疑是最佳选择,业主可以将工程风险绝大多数转移给承包商,投入很少的人力资源便可以完成项目的管理。……
