社会转型期行政权力控制的新路径探析

【摘 要】推行“权力清单制度”是近年来行政机关实施的一种自上而下的改革，实质上是行政控权机制的一种创新，不仅有利于依法行政的加強和行政效率的提高，而且有利于从源头上防止行政权的滥用。本文简要介绍了“权力清单制度”的产生过程，总结了推行“权力清单制度”对行政权控制的意义，同时就“权力清单制度”对行政权控制的路径进行了有益探索，提出了一些建设性意见。

Exploration on the New Path of Administrative Power Control During the Social Transition Period

【Abstract】The implementation of the “power list system” is a kind of top-down reform of the administrative organs in recent years， which is an innovation of the administrative control mechanism， which not only facilitates the strengthening of administration according to law and the improvement of administrative efficiency， also prevent the abuse of executive power from the source. This paper briefly introduces the process of generating the “power list system”， summarizes the significance of the implementation of the “power list system” to the control of the executive power， makes a useful exploration on the path of controling the executive power in the “power list system”and puts up some constructive opinions.

1 “权利清单制度”的由来

2005年，河北省以商务厅、国土资源厅，邯郸市政府为试点，大刀阔斧地推进行政权力公开运行改革，依法清理行政权力项目，公开政务运作流程，在国内引起了很大反响。2013年，党的十八届三中全会通过《中共中央关于全面深化改革若干重大问题的决定》提出“推行地方各级政府及基本工作部门‘权力清单制度，依法公开权力运行流程”。2014年10月，党的十八届四中全会通过《中共中央关于全面推进依法治国若干重大问题的决定》指出“推广政府‘权力清单制度，坚决消除权力寻租、设租空间是建设法治政府的重要措施”。2014年国务院决定向社会公开国务院各部门目前保留的行政审批事项清单，这是中央政府首次“晒”出权力清单。2015年3月，中共中央办公厅，国务院办公厅印发《关于推行地方政府工作部门权力清单制度的指导意见》，明确了推广地方政府部门‘权力清单制度的主要任务、基本要求和时间表。……
