浅析对涉恐在押人员的深挖犯罪技巧与对策

摘 要 当前恐怖活动犯罪严重影响社会稳定和国家安全，形势日趋复杂，监所已成為恐怖活动犯罪线索的重要集散地，是深挖犯罪的重要信息源。在全国反恐维稳的形势下，在监所对涉恐人员开展坦检攻势，深化反恐斗争，增强打击力度，对维护社会稳定具有非常重要的意义。监所在一定时间内集中力量，充分运用政策、法律，强化对涉恐人员教育转化，敦促他们坦白交代余罪，检举揭发他人犯罪或即将犯罪的线索，以此深挖犯罪，扩大战果，开辟警务反恐的第二战场。

Abstract At present， terrorist crimes seriously affect social stability and national security， and the situation is becoming increasingly complex. The prison has become an important distributing center of terrorist crime clues， and is an important source of information for deep crime. In the situation of national anti-terrorism stability， it is of great significance for maintaining social stability to carry out the offensive of investigating terrorist personnel in prisons， deepen the struggle against terrorism and strengthen the crackdown. Focus on supervision of a certain period of time， make full use of the policy， law， strengthening of terrorism related personnel education transformation， urging them to confess the remaining crimes， exposing others to the crime or the crime clues， in order to build up， ferreting out crime， police anti-terrorism of the second field.

在全国反恐维稳的形势下，警务反恐对监所阵地开展深挖犯罪提出了新的挑战与要求。公安监管部门作为打击犯罪的“第二战场”在反恐怖活动的战役中，利用阵地优势，充分发挥监管职能，将深挖犯罪与反恐怖斗争有机结合，以监所内在押的涉恐人员为切入点开展坦检攻势，使监所内深挖余罪成为警务反恐工作的创新发展点。

1 恐怖活动组织和恐怖活动人员

2015年12月27日第十二届全国人民代表大会常务委员会第十八次会议通过《中华人民共和国反恐怖主义法》（以下简称《反恐法》），以援引的形式对恐怖活动组织进行界定。根据《刑法》第26条“三人以上为共同实施犯罪而组成的较为固定的犯罪组织，是犯罪集团”的规定和2011年10月29日经由全国人大常委会第二十三次会议审议通过的《关于加强反恐怖工作有关问题的决定》（现已废止）中“恐怖活动组织是指为实施恐怖活动而组成的犯罪集团”进行界定。……
