从权利到治理

摘 要：随着社会的发展，档案服务研究中的权利话语遭遇困境。文章对档案服务研究中的权利话语进行反思，认为存在权利演变成福利、权利导致“权利病”、权利中实质正义和形式正义脱节等问题。揭示国家治理、档案多元论和社群档案建设等外部因素正在驱动档案服务研究向治理话语转向。最后，总结出档案服务研究的治理话语应体现在档案服务是国家治理的一种重要方式和档案服务是多元主体合作共治的过程两个方面。基于以上研究，以期为我国档案服务研究提供初步导向。

Abstract： With the development of society， the discourse based on rights in the archives service research encounters difficulties. This paper rethinks the discourse based on rights in the archives service research， and think that rights evolved into welfare， and rights lead to rights disease， and the formal justice and essential justice between rights are out of touch. The paper reveals that national governance， archival pluralism and community archives construction and other external factors are drive of the archives service research to turn to the discourse based on governance. Finally， the paper sums up the discourse based on governance of archives service research should be reflected that archives service is an important way of national governance and archives service is a process about multi subject governance based on cooperation. Based on the above research， the paper hopes to provide preliminary guidance for the archives service research in China.

纵观当前对档案服务的研究，多持一种“权利”话语，将档案服务视为公民应享有的一项权利。但是，过于强调权利话语也导致了一些问题。而且，档案服务不仅仅是公民享有的一项权利，它还涉及档案与权力、国家与社会等关乎治理话语的主题。因此，本文对权利语境下的档案服务进行反思，将治理话语引入档案服务的研究中，以期推动并实现档案服务研究从权利话语转向治理话语。

1权利语境下的档案服务及反思

1.1档案服务研究中的权利话语。“人类生活的现时代，是人权观念普及、权利话语盛行、民众权利意识普遍觉醒的时代，有学者恰当地称之为‘权利时代。”[1]“在我们这个时代，让更多的人获享更多的权利，已经成为人类的共同理想，这个理想本身，既表示一种关于权利价值的预测，也隐含着一种关于权利发展的理念。……
