山西农村转型发展中农民权益保护问题研究

摘要 山西省农村在经济社会转型发展中出现了诸多问题，农民的合法权益遭受侵害。结合山西农村经济社会发展实际，指出了转型发展中山西农民权益保护存在的若干突出问题，分别从政策制度、法制和保障机制3个层面深刻剖析了山西农民权益保护存在问题的原因，提出了加强和完善山西农民权益保护的具体建议。

Research on the Problem of Peasants Rights and Interests Protection in Rural Transformation and Development of Shanxi Province

Abstract In the process of economic and social transformation and development in rural areas of Shanxi Province， there had many problems， the legitimate rights and interests of farmers had been infringed. This paper pointed out the problems existing in the protection of farmers rights and interests in Shanxi Province， and profoundly analyzed the reason of the problems from three aspects such as policy system， legal system and guarantee mechanism， then put forward some suggestions on how to strengthen and improve the protection of farmers rights and interests in Shanxi Province.

近年来，随着新农村建设和城镇化、工业化的推进，山西农村经济社会走上了转型跨跃发展的道路。然而，山西农村在转型发展过程中也产生了新的问题，如农民的土地、财产、生命健康等遭受侵害的案件多发，严重侵害了农民的利益，不利于农村社会的和谐穩定，极大地制约了山西农村经济社会的可持续发展。因此，研究山西农村转型发展过程中的农民权益保护问题非常必要。

1 山西农村转型发展中农民权益保护存在的问题

农民权益是指农村居民作为社会成员、国家公民享有的政治、经济、法律、教育、卫生及社会保障等各种权利和应得的利益，包括政治权益、经济权益、社会权益、文化权益等[1]。在农村转型发展过程中，山西省农民权益保护问题主要表现为农民经济社会权益保护存在缺陷、农民土地权益保护相对缺失、农民生态环境权益保护严重不足。

1.1 农民经济社会权益保护存在缺陷
